Which of the following most accurately describes the problem?

ADEFENCE that the addition of side and tail boards, double rear wheels, helper springs and front bumper had not altered the classification of a commercial vehicle taxed in accordance with the fourth schedule of the Vehicles Excise Act, 1949, was rejected by Cardiff magistrates when Welsh Transport Services (Penarth), Ltd., appeared before them.

The company were accused of using a lorry in an altered condition which made it subject to higher tax. Mr. A. Myerson, defending, said that, although the prosecution had shown that the vehicle was seen on two occasions to be of a different description from that given when it was first registered, there was no evidence that it was of a different weight.

He submitted that although the description had altered, the classification according to the fourth schedule had not. When modifications had brought the weight over 31 tons, the tax authorities were informed. It was not until a fortnight later that summonses were issued against the company, stated Mr. Myerson.

Mr. C. Hill, prosecuting, submitted that the description of the vehicle—a B.M.C. oiler—was not at issue. The weight had been increased and an additional £2 13s. 8d. tax to the end of the year was payable.

The company were fined £4 on each of two summonses and ordered to pay I Is. costs.

OBITUARY

WE regret to announce the deaths of Ma. GEORGE BINNINf3TON, MR. J. P. SHAW, MR. WM-LIAM S. NICHOLSON, LT.-Cot. D. C, MCLAGAN, D.S.O., M.B.E., T.D., Ma. IL A. W. SatnvoEas and Ma. JAMES TWEEDIE.

Mr. BinnIngton was superintendent of the private-hire and tours department of East Yorkshire Motor Services, Ltd. Aged 52, he joined the company when they took over Messrs. Binnington's Motors, Willerby.

Mr. Shaw, who was 65, was a partner in Messrs. Hepplewhite and Shaw, hauliers, before nationalization, when he became manager of the Sunderland group of British Road Services.

Mr. Nicholson, who was 72, founded Messrs. W. S. Nicholson and Sons, Cockermouth, hauliers, and was at one time local chairman of the Road Haulage Association. He retired some years ago.

Col. McLagan was a director of Jenner and Matthews, Ltd., Battle, vehicle engineers and agents.

Mr. Saunders was the chairman of H. A. Saunders, Ltd., Austin distributors.

Mr. Tweedie was for many years managing director and chairman of the Ayr company of motor traders which bears his name. He was a member of the council of the Scottish Motor Trade Association. He was 75.
