Which of the following most accurately describes the problem?

IT is not necessary to have springs on 1 a trailer designed for and used in operations over rough roads. This point of law was brought out at Burnley, last week, when -Burrows and Seed, Ltd., Colne, and an employee were respectively charged with permitting the use of, and using, a trailer without springs, mudwings and an efficient braking system.

Mr. A. E. Seed, director and secretary of the company, said that the trailer was of the type used by the War Agricultural Executive Committee and specially • designed for transporting tractors. If the trailer were equipped with springs, there was a likelihood of loads being thrown off when towed over rough roads.

It was impracticable to fit mudwings, because of the width of the trailer No alterations had been made to the vehicle since it had been purchased from the W.A.E.C. There were 'brakes on the trailer, but they were not connected to the towing vehicle.

The company was fined £3 and the employee £1 for using the trailer withant an efficient braking system, and the defendants were each ordered to pay 4s. cost. The other two charges were dismissed.
