• The divisional court has ruled that for material to be subject to controlled waste regulations it must be in the process of being disposed of. In law, waste that is to be processed and re-used is differentiated from controlled waste which is to be dumped.
The court dismissed appeals by Cheshire County Council against a decision by Widnes magistrates, clearing Armstrong's Transport (Wigan) of depositing controlled waste on an unlicensed site and of moving controlled waste without a signed transfer note.
The court was told that the company had been taking concrete beams from a demolition site to be crushed and then returned to the site as infill.
For Armstrong's, it was argued that the material was being recycled.
