Which of the following most accurately describes the problem?

IN their reply to the Minister of I Transport's memorandum on contract carriages, the Municipal Passenger Transport Association have reminded the Minister of " the just claim of municipal operators for equity in the field of contract carriage operation."

"Contract carriage operation," state the Association, "was intended to provide for the public a means of enjoyment which it could not obtain by ordinary stage-carriage, express-carriage or excursions and tours. . " Provided these normal licensed services are adequately safeguarded, the public should have the utmost freedom of choice, and transport operators should be given equivalent rights." The Association consider, generally, that paragraph 6(D) of the memorandum is a sound basis for consideration. This suggests a return to what was originally intended in the 1934 Act; "that the conditions contained in Section 25 of that Act should stand by themselves without any reference to ' special occasion' and that compliance with those conditions should in itself be sufficient to remove the need for a road service licence. " The conditions as set out in Section 25 of the Act of 1934," the memorandum continues, "might be amended (i) by some relaxation of the ban on advertisement to allow publication in certain types of periodical or on the notice board of a club or institution although open to public view (e.g., church magazine, Women's Institute notice board, church porch), and (ii) by the addition of a further condition prohibiting the frequent conveyance to the same destination of parties originating from the same establishment, institution, or community." The M.P.T.A. state, however, that there should be some control on the frequency of conveyance mentioned in sub-section (ii), and suggest the following alternative wording:— " by the addition of a further condition prohibiting the frequent conveyance to the same destination, or vicinity thereof, of parties originating from the same establishment, club or institution, or a party of persons having some community of interest other than the making of the journey or visiting the destination." The phrase "destination, or vicinity thereof" should, state the Association, have the same meaning intended under Section 25 (c) of the Road Traffic Act, 1934.
