Which of the following most accurately describes the problem?

FIRST, it should be remembered that a licence carries no proprietorial rights. The Appeal Tribunal sees no reason why the status quo, preserved during the first licensing period, should be perpetuated afterwards. In other words, the fact that you have sunk capital in a business and rely upon it for your livelihood is no adequate ground for allowing you to continue to operate.

The term " renewal " is, strictly speaking, incorrect, but. if fully understcod, is a convenient description of the process of securing a new licence in substitution for an existing one. In applying for a renewal, you should satisfy the Licensing Authority :— (1) That during the currency of your existing licence, the authorized vehicles have been fully employed.

• (2) As to your gross receipts and tonnage.

(3) That no material change has taken place in the nature of your business. .

Unless it can be proved that thi granting of the application would cause an excess of suitable transport facilities and, if your conduct as a carrier has been satisfactory, you should obtain a licence on supplying the above evidence.

It should be remembered that facilities are not " suitable " unless they are suitable for carrying the goods requiring transport, suitable to the customer on the occasions when he needs haulage and suitable for current industrial and commercial conditions.
