Which of the following most accurately describes the problem?

• Gavin Bertram, of Mid Calder, was granted an additional 2,000gal milk tanker on A licence to operate within 35 miles radius of base by the Scottish LA. Mr. A. B. Birnie. sitting in Edinburgh last week.

The original application included a tipper for agricultural use but this part was abandoned prior to the hearing.

Support was given to Mr. Bertram by Mr. L. M. Paul, area officer of the Scottish Milk Marketing Board, who said that he had to look ahead and plan for bulk handling of milk as additional farms were changing from the use of churns to tanks. He had "scraped through" last year but had extra farms coming on between now and August in the Border area which would demand the additional capacity. He contended that existing milk bulk hauliers would not be affected as there would be ample work for all.

For the objector David Tod, Mr. Dan McKay asked whether Mr. Paul was aware that three existing customers of Tod were being taken from him at the end of April. Mr. Paul agreed and said he had personally signed the instructions. Mr. Tod would not suffer, he said, but Mr. McKay could not see how a haulier could lose three named customers for substantial quantities of milk and not suffer.

Granting Bertram the additional tanker applied for, Mr. Birnie said that he had been impressed by the complete honesty shown by Mr. Paul in giving his evidence. He was prepared to accept that evidence of need for an additional tanker and agreed that he must look ahead to the growth of bulk milkhandling. But he would insist that no other haulier involved, should suffer financially or otherwise, as a result of this grant. He would watch the position carefully and take a personal interest in the operation.
