AN INQUIRY INTO the death of a cyclist killed when he was hit by a truck will investigate the part a mobile phone played in the accident.

Stephen Barclay died last April when he was struck by an LGV on the A835 at Leanig Brae, Scotland.

Truck driver Angus Mac phail was fined £1,000 and banned from driving for a year after admitting careless driving.

A preliminary hearing was held at Dingwall Sheriff Court last week to decide the scope of the fatal accident inquiry, Macphail's vehicle was travelling at 60mph at the time of the accident on a road with a 40mph limit for trucks.

Solicitor John Muir, representing Barclay's family, said they saw no rational explanation for the accident other than that Macphail and his passenger were distracted by a ringing mobile phone.

Sheriff Alasdair Macfayden ruled that evidence would be allowed on the mobile phone and Macchairs tacho records for the day of the incident.
