Which of the following most accurately describes the problem?

• The Transport Tribunal has decided to allow in part two appeals by hauliers against the decisions of LAs. The appeal of J.W.H. Watson (Rochester) Ltd was against the decision of the South Eastern LA to curtail the ten vehicle licence by four vehicles for six months (CM February 16).

• The Tribunal has decided that although the allegations at the hearing concerned the condition of the vehicles — and these were "by no means negligible matters" — the penalty imposed by the LA was in the circumstances too severe. The curtailment has therefore been reduced to run for a period of three months only.

The second judgment concerned the appeal of D.K. Demolitions Ltd against the decision of the Eastern LA to revoke the company's licence for three vehicles (CM February 16). The LA had said that he was not satisfied that there would be a satisfactory inspection and maintenance system in operation by the company. The Tribunal has stated that while it felt no more satisfied than the LA, the company should be allowed to show, if it can, that its new arrangement is sufficient to comply with the requirements of the Act. The licence was therefore only reduced by two vehicles.
