Of the seven immediates, he said that they included inherent design faults to the braking system of the type of vehicle his company had been operating. Of the seven immediates, three concerned these handbrakes, one was on internal gears which could not be seen by any system of inspection and one concerned breaking of bolts which could have happened at any time. It was not, he said, a wonderful record but the crux of the matter was that there were different interpretations of "fit and serviceable". By introducing the new defects notices, the DoE had admitted that the GV9 system was unsatisfactory.

Mr McNeil claimed that his firm's facilities were sound, and their recordings in order. But no matter how good the system was, vehicles did break down and become unserviceable and it was beyond the ability of any system to prevent such happenings.

Mr Birnie said that the firm had described their difficulties with honesty and had been given a good report from the examiners. But they still had this list of prohibitions and he would have to make curtailments. He wanted to see this flood of GV9s stopped.
