Which of the following most accurately describes the problem?

S.E. Commissioners Acted Wrongly THE Minister of Transport last week ordered the South Eastern Traffic Commissioners to rehear applications by Southdown Motor Services, Ltd., and B. S. Williams, Ltd., for road service licences in respect of stage services between Midhurst and Petersfield.

B. S. Williams, Ltd., had appealed against the granting of a licence to Southdown and the refusal of their own application.

In a written decision the Minister said that the main issue was whether the Commissioners were correct in reaching a decision before all available evidence had been heard. They acted wrongly. He was " concerned to see that decisions arc reached in accordance with the natural principles of justice and the spirit of fair play and openness emphasized by, inter alia, the Franks Committee on Administrative Tribunals and Enquiries."

Since all the evidence known to exist was not called. the Minister could not uphold the Commissioners' decision, and he therefore ordered that both applications be reheard. NORTHAMPTON ROUND OF LORRY DRIVER COMPETITION
