OMNIBUS CO. obtained judgment in the High Court last week against Worcestershire County Council who Mr. Justice Stamp declared had acted wrongly in closing a gap between the two carriageways of the Halesowen by-pass.

The council closed the gap giving the company only six days' notice and forced three services to be diverted leaving an area with a population of several thousand people without a bus service. Permanent closure would have cost the company £15,000 and meant an additional 30,000 miles a year.

The judge awarded costsagainst the council but suspended the injunction for a maximum of 10 days to enable the council to give notice of appeal.

Mr. Derek L. Fytche, Midland Red Traffic Manager, said afterwards: "The judgment shows that highway authorities cannot expect to rely on the provisions of Section 65 of the Highways Act 1959 and the Traffic Signs Regulations and General Directions 1964 as authority to close side roads and/or intersections."
