AT Birkenhead Borough Police Court, on July .20, Mr. Owen McCoy, a Birkenhead haulier, and Mr. John English, a driver, were summoned for offences under the Road and Rail

Traffic Act, 1933. Mr. English was summoned for driving a goods vehicle, carrying a :lumber of calves, when a prohibition order was in force. Mr. McCoy was summoned for permitting the use of the vehicle, and for permitting the vehicle to carry goods for hire or reward without a Ticence. , Mr. D. H. Mace, for the prosecution, said that, having found various defects in the vehicle, an examiner mule a prohibition order, stating that the machine should be repaired within 10 days. Later, it was seen entering Mersey Tunnel laden with calves, •the prohibition order still being effective.

Referring to the use of the vehicle without a licence, Mr. Mace said that Mr. McCoy's story was that he made proper application to the Licensing Authority before September, 1934. On September 19, however, he asked for a short-term licence, which was granted, pending the hearing of his application. The short-term licence expired on March 24, which meant that he had no licence when stopped on April 15. The full licence was granted on April 16. • Mr. G. D. H. Currie, for the defendants, declared that, so far as the latter offence was concerned, Mr. McCoy had been informed that it would be in order for him to continue to use his vehicle until such time as his application was heard. Immediately the prohibition order came into effect the vehicle was withdrawn and repaired.

Mr. English was dismissed under the Probation of Offenders Act and ordered to pay 4s. costs. . " It is quite apparent that you did not take tho proper precautions with regard to the use of this vehicle," remarked Alderman R. P. Fletcher to Mr. McCoy, For the first offence he was fined 40s. and for the latter 10s. He was also ordered to pay £2 3s. costs.
