THE police did not contest an appeal brought before the Queen's Bench Divisional Court last week, by Mr. Thomas Victor Prior, Bucknalls Lane, Watford, against his recent conviction at Becontree for an alleged licence offence.

The magistrates found that last July in Eastern Avenue, Ilford, Mr. Prior drove a car drawing a 2-cwt. trailer in which was a miniature billards table. They said that Mr. Prior, who carried on business as a dealer in and repairer of billiards tables, was taking the table in the trailer to repair it. They fined him on a summons alleging that he used a goods vehicle without a B licence.

Mr. Prior contended that he was not using the car and trailer for hire or reward in the course of his business.

When the Lord Chief. Justice asked whether any explanation had been given by the police as to why they prosecuted in the case, Mr. Prior's counsel replied: "Nothing has been said about that."

Lord Goddard: "I rather think the Metropolitan Police ought to have offered some explanation to the court as to how they came to prosecute."

Mr. Prior's appeal was allowed with costs and the conviction was quashed.
