IGHT Lincolnshire hauliers and the

British Transport Commission were spccessful on Tuesday in appeals to the

Transport .Tribunal against the East

Midland Deputy. Licensing Authority's grant of an A licence for a lorry, to be based at Louth, to C. P. Marshall (Transport), Ltd., Ashbyville, Scunthorpe.

Mr. Hubert Hull, president, said the Tribunal thought that they knew too little about Marshall's business as a whole to form any conclusion whether there should be an additional vehicle.

It was a mistake, where two bases were concerned, that the Tribunal

should have figures relating to only one base. Marshall's had bases at Louth and Scunthorpe and the Tribunal thought it was essential to have figures for the wliole fleet.

Refusing an application for an adjournment to produce these figures.

Mr. Hull said that there might be a case if the proper figures were considered at a fresh hearing. Therefore, in allowing the appeal, they would not remove the vehicles from the road. pending a fresh application.

The Tribunal's order would be suspended for three months on condition

that Marshall's made a fresh application or until the new application was determined by the Licensing Authority.

The haulier appellants were E. Briggs and Sons, Ltd.,. Louth; C. W. Clark.

Cleethorpes; W. F. and E Coxon, Ltd., North Thoresby; F. A. Stark and Son, Tetney; and J. A. Ellis, I. 'R. Goodwin and Co., Ltd., Greaves and Lamming. Ltd., and North Lines Haulage Co.. Ltd., all of Grimsby.
