IN the motor horsebox test case which

had a five-day hearing in two periods at York, the Yorkshire Licensing Authority (Major F. S. Eastwood) has, in a reserved decision, granted the applications by nine trainers of racehorses for B licences in substitution for the C licences under which they have hitherto operated their motor horseboxes. It is anticipated that the Railway Executive, as objectors to the applications, will take the case to the Appeal Tribunal.

The case resulted from a notification by the Licensing Authority to a number of Yorkshire trainers, in October last, that where they carried their patrons' horses for hire or reward they should apply for B licences. In granting the applications, Major Eastwood states that the B licences will incorporate a special condition to the effect that the vehicles, when used for hire or reward, shall be used only for the carriage of those racehorses which had been trained by the licence-holder at his own establishment.

"if I were to refuse the B licences applied for." he said. "the position would be that trainers would be forced to use almost exclusively vehicles operated by the Railway Executive.

do not know of any instance, other than racehorses, where it is suggested that a person is not permitted to avail himself of the two alternatives of transport of his goods, i.e., public transport or private transport under a C licence.

"Whilst granting B licences to a certain number of trainers, I wish to warn them that if it be found that the conditions of the B licences are infringed in any way, I have power under Section 13 of the Road and Rail Traffic Act, 1933, to revoke the licences, and I shall have no hesitation In so doing if this becomes necessary" The B licence grants are to Messrs. W. A. Hammett (Beverley), R. E. Davey, E. Street, W. J. Bellerby, W. P Dutton and J. Thwaites (all of Mahon), Captain G. R. Armstrong and Colonel W. E. Lyde (both of MiddIeham), and Mr. R. Renton (Ripon).
