It shouldn't surprise anyone that the Traffic Commissioners want to crack down on 'hired-gun' nominated CPC holders. They've frequently grumbled about them at Public Inquiries and are clearly keen to finally determine what actually constitutes a "continuous and effective" responsibility. North Eastern TC Tom Macartney has already threatened to revoke the 0licence of anyone employing an 'agency' transport manager who doesn't have a genuine involvement in the business. So this is an excellent opportunity for the industr to say what it thinks should be the minimum weekly commitment from nominated managers. Why? Because in a trade where over 75% o all UK operators have five or less trucks, there is clearly a role for nominated managers. Such small fleets will struggle to afford a fulltime transport manager and may only require part-time management anyway. There's a limit to how man) operators one single nominated manager can practically control—bt any part-time manager who winds up in front of the TC because his client has fallen foul of the law (either deliberately or unintentionally) can hardly claim to have exercised 'effective' control. If they had, they wouldn't be up in front of the beak, would they? Indeed, anyone considering using a nominated manager should ask: "Have you ever had to
