Which of the following most accurately describes the problem?

• A driver dismissed by Hudson Shepherd Transport after causing an accident which led to heavy losses has won 2250 compensation for unfair dismissal from a Leeds Industrial Tribunal.

In ordering the company to pay compensation to driver Malcolm Platts, the tribunal said that the accident, which occurred on October 15, 1986 was the latest in a series of accidents in which Platt had been involved over the last five years.

Even so, they felt the company had not acted reasonably in that it did not make a full investigation into Platt's side of the story before he was dismissed. Despite his previous record the company did not give Platt a warning at any time that any further similar incidents would lead to his dismissal. Consequently the tribunal felt that the company had fallen short in its disciplinary procedures.
