• No decision was given by the Transport Tribunal at the appeal of Pude Waste Disposal {South Eastern} Ltd. in London on Tuesday. Clearers (South East) Ltd. was respondent.

Mr. M. H. Jackson-Lipkin, for Purle, said that the appeal arose from the granting of a El licence for a six-ton skip lorry to the respondent company by the South Eastern LA.

The application for this licence was first heard at a public inquiry on March 7, 1968. The case was, however, not concluded. On March 28 the hearing was resumed and the application refused. Between these two hearings the respondent had been granted a short-term licence, enabling him to operate from March 15 to April 14.

In December the respondent was granted a B licence authorizing the carriage of industrial waste excluding toxic and inflammable waste for disposal to tips within 10 miles of operating centre for named customers. It was against this grant that the appeal had been brought.

It had been freely admitted at the public inquiry that Clearers had been operating without any licence, said Mr. Jackson-Lipkin. and by granting the company a licence the LA had "followed meekly and like a lamb in the wake of a haulier who has flouted the law".

Mr. J. T. Purser, for the respondent company, said that Clearers began operations in 1968 and provided a free service in an area where this type of service had formerly been unavailable. This soon became impossible to continue and the company was advised to hire out buckets and not charge for haulage.
