Which of the following most accurately describes the problem?

UNSPENT CASH allocated by the Department of Transport for Bus Grant payments this year are likely to be made available to operators after a January meeting between the Department, the Confederation of British Road Passenger Transport and the Association of District Councils. This will, also review the allocation of grants between different sectors of the industry and to individual operators.

Last week the DTp un-froze payments to municipal operators after advice from Treasury legal experts, that the ADC could not force the Department to pay out bus grant cash where an "approval principle" certificate had be issued to an operator, becau bus grant payments we voluntary (CM last week).

. But the DTp's interpretatic that it was entitled to chant the bus grant regulations between the approval beir issued and payment of a grant was questioned by a ADC.

In a letter to the AD announcing that bus gran would be restarted, DTp pe manent secretary Peter Bak win had said, "The Depar ment can contend that, there can be a substantial tim gap between the approval an the actual application fc grant, it must be entitled t change its policy."
