Which of the following most accurately describes the problem?

I refer to the article in CM 3-9 April 1997 I headed "Misleading hours guide". With clarification on certain aspects of the legislation appearing from Brussels, and court cases in the UK creating case law, interpretation of the legislation governing Drivers' Hours has changed in some areas.

This particular case I believe refers to split daily rest Article 8(1) 3820/85, where the European Courts' interpretation of a 24-hour period was clarified as a result of the Van Swieten and 394/9 Michielsen cases which resulted in determining that if the daily rest was split into two or three separate periods, the eight-hour period must be in the last portion of rest. Prior to this it was believed the components of split rest could be taken in any order. It is essential that operators and drivers become aware of any changes and ensure that their reference sources are up to date. Tachodisc has a Drivers Handbook published in late 1996 which incorporates all the changes to date.
