Which of the following most accurately describes the problem?

THE applications of A One Transport (Leeds) Ltd. and CNC Transport Ltd. have again been refused by the Yorkshire deputy Licensing Authority, Mr. I. H. E. Randolph, after being remitted by the Transport Tribunal for further hearing (see The Commercial Motor, July 2).

In his written decision Mr. Randolph said he had approached his decision on the basis that a prima fade case of need had been established by the applicants and he had therefore paid particular attention to the evidence given by the objectors. This was a case in which there was only one person—namely, Concrete (Northern) Ltd., who required the facilities provided by the applicants and he had all the facilities he wanted, although not in the form he wanted them.

"The gravamen of this case is What will be the position when Concrete (Northern) Ltd. do not want all the facilities which are provided for them by the applicants? If these applications were granted the effect would be to release anything up to 28 vehicles into the pool of transport in the Leeds area; they would, moreover, be available for the carriage of return loads into this area at all times." It was suggested that the applicants could themselves utilize these 28 vehicles at such times as Concrete (Northern) Ltd. did not require them. The applicants' figures of hiring show there is already an abundance of suitable transport in Leeds or they would not be able to achieve the level of hiring.

When coupled this with the evidence of the facilities provided by the objectors, he was quite satisfied that the grant of these applications would result in an excess of suitable transport facilities, added Mr. Randolph.
