Which of the following most accurately describes the problem?

Mr. J. H. VV Stirk, presiding at the Nottingham Traffic Court on December 15; as "a novel objection " was' heard when Messrs. Bevan. and Barker, Warsop Road Garage, Mansfield •Woodhouse, applied for renewal of their licence.

On behalf' of the objectors—the Mansfield District Omnibus Co., and the Ebor Bus Co.—it was said that the objection was based on the grounds that the applicants had not attempted to make use of the licence granted to them six years ago, whilst, on the other hand, the companies objecting had run complete services to the same places, except Blackpool.

Mr. Stirk: It is a novel point you have made, and it has not been made before. I think you are asking us to create a dangerous precedent." It was emphasized on behalf of the objectors that the applicants had made no attempt to operate.

It was contended that it was unfair that the applicants, who had not properly used the facilities of the licence, should be permitted to interfere with two companies which ran a complete service to the same places.

Mr. Stirk said that a case something like the present one occurred at Wolverhampton, and the Court thought it was unfair for a company, which ran a complete service, to be interfered with by another operator who did not run such a complete service and the renewal of his licence was refused. An appeal decision was upset by the Minister, added Mr. Stirk. .

The application was granted, the excursions to run' as previously, with the exception of a service to Alton Towers and Manchester.
