Which of the following most accurately describes the problem?

ATRIP during which 12 of the party were left behind, because they missed the coach at a halting place, had a sequel in an action at Halifax County Court on April 15, when Messrs. Brearley's Tours, Halifax, -unsuccessfully claimed £8 balance of the coach hire charge from Robert Chatfield, now of the Wagoner's Rest Hotel, Luddenden.

For the plaintiffs, it was stated that the coach was hired by the defendant, on behalf of a party, for £18 2s. 6d. When the coach stopped at York during the return journey, it was arranged to leave at 9.30 p.m.; but 12 of the party had not returned by 10.15 p.m., so the driver did not wait any longer for them. Ten of those left' -behind completed the journey by taxicab, at a cost of £8, which was paid out of the coach money.

Giving judgment for defendant, with costs, Judge B. R. Rice-Jones said that the coach was booked for the day, which meant up to midnight He thought that the driver should have given the party more latitude.
