Speaking at the Association of Road Transport Lawyers conference last weekend, Kirkbright said the Law Commission has accepted that a corporation can commit manslaughter. A company could now be convicted of both reckless manslaughter and negligent manslaughter.

As most transport firms run fewer than five vehicles, it is very easy to link the director to the crime, said Kirkbright.

The Law Commission has also proposed that the emphasis should be on negligence, rather than recklessness when assessing manslaughter charges.
