Which of the following most accurately describes the problem?

A SUBSIDIARY of Kammac Trucking, the Lancashire haulier which won a celebrated self-employed drivers case two years ago, has been granted a new national licence for 50 vehicles and 76 trailers.

Kammac International sought a licence from North Western Licensing Authority Roy Hutchings for 18 vehicles and trailers in possession, the remainder to be acquired, based at Skelmersdale.

Kammac counsel Tony Grant said the company had grown. From the parent company had come Kammac International and Kammac GES, the latter occupying a 3.8 hectare (9.5 acre) former Courtaulds site at Skelmersdale with substantial warehousing and parking facilities.

It is the major carrier for Kelloggs, Beechams and Ford, and needs more than the 35 vehicles and 40 trailers authorised to Kammac TruckMg.

A "major British and American car company" has indicated that it wants Kammac to handle its UK distribution, • that could not be done with the existing fleet. .

Stephen Evans, Kammac's service manager, said 17 vehicles and 35 trailers were owned and maintained by Kammac. The remainder are contract hired from Salford Van Hire, which is responsi hle for their maintenance. The additional vehicles would be contract hired.

The company has a tough policy on drivers' hours. Tachograph charts are analysed and action is taken against any driver who breaks the regulations.

Evans added that Kammac Trucking employed the drivers and sub-contracted them to Kammac International.

Grant said that the basis of the employment of the drivers had been redefined since Kammac last appeared before the LA and the company is now responsible for income tax and National Insurance deductions.
