TUDGMENT for £62,420 was given J in the King's Bench Division, on Monday, for Mr. Walter Guildford Goode, an engineer, of Cypress Avenue, Whitton, Middlesex, against J. March and Co., Ltd., Fenchurch Street, London, E.C.

in December, 1946, Mr. Goode entered into an agreement with I_ March and Co., Ltd., that it would pay him a commission of £20 per vehicle on used lorries purchased for export as the result of introduction by him. In 1947, he introduced 3,037 United States surplus Army lorries in Germany to the defendant and these were purchased from the American authorities by a Swiss associate concern Of J. March and Co., Ltd.

The company contended that the agreement with Mr. Goode was limited to lorries bought in the United Kingdom, although it agreed that Mr. Goode was entitled to be paid for introducing vehicles in Germany_ Giving judgment, Mr. Justice Finnemore said that it was plain that Mr. Juan March was most anxious that the opportunity of acquiring the 3,037 lorries should not he missed and he told Mr. Goode at Geneva to go straight to Paris and make sure he obtained the contract for them.

His lordship was satisfied that there was no term in Mr. Goode's agreement with J. March and Co., Ltd., which in any way limited its operation to the United Kingdom. He found that Mr. Goode was entitled to £20 commission on each of the 3,037 vehicles, amounting to £60,740, also to £1,680 for other services rendered to the defendant in the purchase of the lorries.

Judgment was also given for Mr. Goode for interest on the amount, together with the costs of the action.
