Which of the following most accurately describes the problem?

A CASE involving a driver agency and use of a driver without a heavy goods vehicle driving licence was part heard before Carlisle magistrates on Monday.

A Chichester firm. E. Allman and Co Ltd admitted employing a driver without an hgv licence to drive a Class I articulated vehicle. The driver, Adrian Peter Cotton admitted driving without the appropriate licence and to failing to have a record book in his possession.

Mr G. W. Worthington, prosecuting for the Northern LA, said a vehicle belonging to Allman was stopped in Carlisle on November 15, 1973, when the driver was unable to produce an hgv driving licence or a record book. Inquiries showed he had not been granted a licence.

In a Written plea of mitigation the company said driver Cotton had been hired from a driver agency and it was assumed everything would be in order. When a company executive asked Cotton whether he held a Class I licence, he was assured that he did and his word was accepted.

The magistrates fined the company E5 with £12 costs, and driver Cotton ES for no licence and £10 for no record book plus £12 costs.

It is understood that the Northern licensing authority is to prosecute the agency concerned.
