• A Derbyshire based owner-driver, said by a DOT vehicle examiner to have picked up a worrying number of prohibitions in the past 12 months, escaped with a warning when he appeared before North Western Traffic Commissioner Keith Waterworth.
Chesterfield haulier David Kendall, trading as DK Haulage, was called before the TC because of concerns over his maintenance record.
Vehicle examiner David Johnson said Kendall had had diffi culty in clearing immediate prohibitions imposed on a vehicle and trailer in April 1996.
Johnson had examined the vehicle and trailer in January and imposed a defect notice Waterw on the tractor with an prohibiti immediate prohibition for a brake defect on the trailer.
He agreed with Paul Carless, for Kendall, that it was very worrying to see an operator taking live shots at clearing a prohibition. Johnson claimed that the commercial garage carrying out the maintenance had told him that the type of vehicle operated had difficulty meeting required brake efficiency levels. Kendall said he had since replaced the vehicle. The commercial garage had taken a long time to get to the bottom of the brake problems, he added.
Waterworth said that Kendall's performance had been unacceptably low. However, the fact that he had now taken advice had been taken into on warning. account.
