THE WEST MIDLANDTraffic Commissioner David Dixon's refusal to grant a one-vehicle international licence to Telford, Shrops-based Pegasus Logistical Solutions on financial grounds has been upheld by the Transport Tribunal on appeal.

The licence application was submitted in June 2006 and, at the end ofJuly,theTraffic Area Office requested in writing financial information to show that the company had the req uired £6,200 available. In August, a further letter was sent acknowledging the receipt of some documents, and requesting hank statements for May, June and July, as those already submitted were too old to be taken into account. No reply was received to that letter nor to two others sent in September.As a consequence, the application was refused.

In the firm's notice of appeal, MD Michael Joynson stated that the failure to meet the most recent deadline was due to an oversight in the office and the bank statements being with the company's accountants.

Dismissing the appeal, the Tribunal said the firm had failed to respond to a number of letters requesting financial information or to meet the final deadline set in the letter of 20 September. There was no material before the TC to satisfy him that the company met the requirement to be of appropriate financial standing. It considered the TC right to refuse the application.
