THE appeal of Robson Bros. (Haltwhistle) Ltd.

(CM May 5) against the decision of the Northern LA who had refused to grant a B licence for four vehicles, has been dismissed by the Transport Tribunal in a written decision.

The Tribunal took the view that the evidence of availability of the objectors was so weak that it would not have made a good prima facie case. But it also took the view that the application was weak and that a grant to cope with the proposed work on the Penrith by-pass would have been premature..

The Tribunal suggested that as the appellant was now a wholly owned subsidiary of Harrison's Limeworks Ltd., and much of the work proposed for the B licence was on Harrison's behalf, it could be carried on C licensed vehicles.
