IN A truck driver is awaiting surgery following a road rage attack by a BMW driver.

Leicester Crown Court heard how Donald Winter was attacked in the cab of his 17.5-tonner by Eric Davis who was wielding a wheellarace.

The attack happened in October 2001 when Winter pulled up at red traffic lights in University Road, Leicester. Davis, of Otter Lane, Mountsorrel, turned into the same road and found his path blocked by Winter's truck.

The jury heard how 28-year-old Davis started shouting abuse at Winter before getting out of his BMW for a confrontation. He repeatedly tried to open the cab door before returning to his car and arming himself with a wheelbrace from the boot. Winter told the court: "Because of the traffic lights I couldn't move. There must have been some parking space to my left and he wanted to get in it."

Winter said his side window shattered after being hit with the wheel brace, sending glass flying. His elbow was struck as he put up his hand to defend himself: Winter was off work for a month and is still awaiting surgery.

Davis pleaded not guilty to causing actual bodily harm and also denied damaging the lorry window, claiming he was a victim of mistaken identity.

However, the jury took 23 minutes to unanimously convict him and he was remanded in custody to await sentencing.
