Which of the following most accurately describes the problem?

ARECENT appeal by the Transport Holding Company against a decision of the Yorkshire deputy Licensing Authority was finalized this week when the Transport Tribunal issued its findings in writing. The appeal was allowed in part The original application from four members of the Goole Tipper Group was to vary their existing B licences covering five tippers and four flats by the addition of the • words: "Goods for and on behalf of the Marshland Forwarding Co. Ltd., Goole, within a radius of 100 miles of Goole Post Office". Objectors were the Transport Holding Company and British Railways.

The deputy LA granted each of the applications in part by adding the conditions: "Goods passing through the port of Goole for and on behalf of the Marshland Forwarding Co. Ltd., and within a radius of 100 miles of Goole Post Office". The THC appealed against this decision.

In considering the appeal, the Tribunal took into account that there had been no original evidence for 100 miles and, in fact, the witness supporting the application had said that he wanted goods carried within 75 miles at the outside and 50 miles to meet most of his requirements.

No case had been made out for the proposed variation in respect of the flat vehicles or in respect of any traffic other than that which passed through the court. The THC was unable to meet the need for tippers and in the opinion of the Tribunal, the evidence given at the original hearing was sufficient to prove the application. The Tribunal however, considered that there was insufficient evidence to support the grant made in the terms of the deputy LA.

The appeal was allowed by amending the variation of the condition to limit the radius to 50 miles for the tippers.
