7 'about Gibratter, not UK' By David Harris THE DEPARTMENT for Transport (DfT) has revealed that a court case taken by the European Commission against the UK for not enforcing European law on truck drivers' hours (UK faces EU 'working time' legal action', CM 12 June) is actually about Gibraltar, rather than Britain.

The Commission first announced it was taking the British government to the European Court of Justice over the issue in June, but did not give a full explanation of why it was taking action. All it said at the time was that the UK had not informed the Commission on how it intended to enforce the directive on drivers' hours. This puzzled some observers because drivers' hours rules appear to be enforced strictly in the UK.

The case is now with the European Court of Justice, and both the DfT and the European Commission are still reluctant to reveal much about the dispute.

However, the DfT does say that the drivers' hours directive "has been implemented in Great Britain and Northern Ireland, but not Gibraltar".

It adds that it is working with the Government of Gibraltar to rectif> this as soon as possible.

It remains unclear why the case got as far as the European Court of Justice before being resolved, with the Commission saying that it does not go to the court straight away, but issues two warnings first.

Both the DfT and the Commission now say they cannot comment further because the case is with the court.
