Which of the following most accurately describes the problem?

QIt seems that your answer to the problem of writing on the face of tachographs (CM 7-13 Dec) has created confusion with our drivers. We took note of Mr Green's reply and can see both sides. Can you put this debate to bed once and for all.

DOB, Scunthorpe ALord Scant= recently said that common law allowed that: "An individual was innocent until proven guilty — provided that what he was doing was not unlawful by legislation". This is called an "absolute offence".

Marking the face of the tachograph is not an absolute offence. The advice to so mark the tachograph record is good advice if it assists in checking the record and stopping infringement. I have spoken with David Green of the FTA and agree with his comments.
