Which of the following most accurately describes the problem?

• Bristol ownerdriver Anthony Lloyd has been given 28 days to pay fines and costs of £1,600 after being convicted in his absence of drivers' hours offences and using a vehicle without an 0-licence.

Lloyd, who had denied eight hours-related offences, had written requesting an adjournment. But the West Bromwich magistrates decided to hear the case after being told that it had already been adjourned once after Lloyd's wife had phoned to say he was out of the country.

DOT traffic examiner Malcolm Seward said that when Lloyd's 38-tonne artic was stopped in a routine check it had no 0-licence identity disc.

Lloyd had said that he worked exclusively for a company called C&R, and had believed he could operate under C&R's licence. The vehicle had been painted in C&R's livery but had Lloyd's name across the front.

A full analysis of the tachograph charts showed that he had driven for up to 10hr 54min in a day, had taken a daily rest period of only 8hr 18min and had driven for as long as 7hr 52min.

Prosecuting for the DOT, Nicola Purchase said the offences were particularly serious in view of the extent to which the drivers' hours limits had been exeeded.
