Which of the following most accurately describes the problem?

• An appeal to the Transport Tribunal by Mr Dennis Clemetson, of Cockermouth, after his 0-licence application for two vehicles and trailers in possession and one vehicle and low-loader trailer to be acquired was refused by Mr J. A. T. Hanlon, the Northern LA, was dismissed by the Tribunal on Wednesday.

The appeal originally came before the Tribunal on June 3 (CM June 12) but was adjourned because of the absence of sufficient evidence on which to base a decision. The additional evidence, particularly in respect of various prohibitions incurred by the appellant, was supplied to the Tribunal by the clerk to the Northern LA.

Mr T. H. Campbell Wardlaw, for the appellant, said that of the seven GV9s incurred during the five years prior to the application only three referred to vehicles which were the subject of the application and two of the remainder were for vehicles which were examined in an unladen condition on private property while awaiting repairs. Mr Wardlaw said that Mr Clemetson wished to stress to the Tribunal that these two vehicles would not have been used on the road in the condition that they were found by the examiner.

The Tribunal dismissed the appeal and said it would give its reasons in writing.

Mr Wardlaw asked if the decision could lie for 14 days but as the appellant has no known authority to operate, the Tribunal said it could see no reason for making special provisions, and the written decision would take its normal course.
