A CHESHIRE operator who failed to carry out his duties as another haulier's transport manager has had his licence application refused and has lost his repute.

Congleton-based Mark Skellern held an interim licence and had applied for a licence for two vehicles and two trailers before North Western Traffic Commissioner Beverley Bell. He was the nominated transport manager on a licence held by Sandbach-based Alan Bowyer. Vehicle examiner Proctor said Bowyer had no maintenance records for a six-month period. Bowyer had said Skellern did not play an active role in the business. Skellern's inspection records showed defects that had not been rectified, many of which would have been prohibition items.

Bowyer said he took pride in the condition of his vehicles. Skellern agreed that when the interim licence was granted, he had agreed to have the maintenance undertaken by Isherwoods, for whom he was also transport manager. But he had them maintained by other contractors and had never used Isherwoods.

Holding that Skellern had lost his repute, the TC said she was extremely concerned about one of his inspection records, which was so bad that it ran to three pages. She was satisfied that Skellern had put commercial considerations above road safety and that he had let Bowyer down.

Suspending one vehicle from Bowyer's two-vehicle licence for one week, theTC accepted that his vehicles were fit and serviceable. She gave him three months to find an acceptable transport manager.
