Which of the following most accurately describes the problem?

• An appeal by Sa Hord Stone & Steel against the level of a fine has been adjourned at Bolton Crown Court. Judge Harry Kershaw decided the company really wanted the conviction itself to be quashed.

Rochdale magistrates had fined the company £2,000 for using a vehicle without an 0-licence; £200 for using a trailer without a plating certificate; £500 for failing to have a tacho check on alternate years; and £500 for using a vehicle under trade plates for the carriage of goods.

For the prosecution, Nigel Poole said last March a five-axled Volvo artic laden with engine parts was stopped in a check. No 0-licence disc was displayed and the tacho had last been inspected in 199(1 The trailer's MoT test certificate had expired. A second vehicle belonging to the company was later directed to the same check.

Director Peter Cleary had admitted the company owned the vehicles and employed the drivers. The goods being carried on the vehicle displaying the trade plates were being delivered, but as the company was not getting paid for them, he did not think a vehicle excise licence was needed.
