Which of the following most accurately describes the problem?

ON appeal, the Minister of Transport has upheld the decision by the Yorkshire Licensing Authority to renew the licence of an independent firm, Messrs. J. Boddy and Son, of Bridlington, to operate a stage-carriage service between Filey and Flamborough. The appellant was East Yorkshire Motor Services, Ltd., Hull, which, at the same time, unsuccessfully appealed against the Licensing Authority's refusal to grant the company a similar licence to operate between Filey and Flamborough.

The licence for Messrs. Boddy's service between Filey and Flamborough, not hitherto linked by stagecarriage operation, was first granted for one year, in 1947, notwithstanding objections by East Yorkshire Motor Services, Ltd., and United Automobile Services, Ltd., Darlington, for which it was argued that if a new service were to be authorized, they had prior claims as operators of existing services in the district.

When Messrs. Boddy applied for continuance of their Filey-Flamborough service at the end of the first year, "East Yorkshire" contested the application and asked for an identical licence. The company said that it had had in mind the introduction of such a service, but shortage of Vehicles had delayed matters.

The Licensing Authority held that the Filey-Flamborough service had proved its worth as a summer service for holidaymakers and as Messrs. Boddy had initiated the facilities they should be authorized to continue them.

The Minister has also upheld the Yorkshire Licensing Authority's decision to allow Wallace Arnold Tours, Ltd., Leeds, to operate on additional dates its period excursion from. Stanningley to Blackpool. The appellants wereMessrs. J. W. Kitchen and Sons, of Pudsey, who, as operators of a summer express service from the same neighbourhood to Blackpool, argued that they were entitled to any additional Blackpool traffic on this route. Messrs. Kitchen had been refused permission to operate additional vehicles on their service, although they, too, had been granted additional dates.
