A N accusation that the British Trans

port Commission had been guilty of breach of contract was made by Mr. T. H. Campbell Wardlaw before Newcastle-on-Tyne magistrates recently. He was defending R.A.H. (Transporters). Ltd.. who were summoned for operating outside the 25-mile limit.

The company admitted the charge, but slated that they were entitled to run over 25 miles. Mr. J. L. R. Croft, prosecuting for the Northern Licensing Authority, said that the concern could run beyond 25 miles if a notice of acquisition had been served on them by the R.T.C. and had not been withdrawn.

In 1949. a notice of acquisition was issued but within a few days the defendants asked the B.T.C. to withdraw it. The matter was referred to the Transport Arbitration Tribunal and in February, 1951, the company urged the Commission to buy their shares. Negotiations made no headway and last July the B.T.C. withdrew their acquisition notice. After that date, the company had not been entitled to operate outside 25 miles, said Mr. Croft.

Mr. Wardlaw said that the notice could not have been withdrawn while the matter was still being considered by the Tribunal. The breach of contract over the proposed purchase of shares would be dealt with in another court.

The magistrates reserved their decision.

FORD OFFER FAVOURED

THE directors of Briggs Motor Bodies, Ltd., have recommended the shareholders, at a meeting on May 15, to accept the offer of the Ford Motor Co., Ltd., to buy about 62 per cent, of the ordinary shares in the Briggs concern, and to acquire the 756,062 remaining shares.
