John Board, trading as Traction Europe, Rossendale, had been called before the North Western Deputy IC Elizabeth Perrett at a Leeds Public Inquiry. He was seeking a new international licence for three vehicles and three trailers.

Shortly before the inquiry began, the Traffic Area Office received a sick note saying that he was suffering from stress.

The DTC said that at one time, a licence was held in the Western Traffic Area by an Andrew Williams. In November 2000, that licence was revoked, and Williams disqualified for 10 years by the Western Traffic Commissioner Philip Brown.

It then appeared that Williams changed his name to John Board by deed poll. In November 2001, Board applied for and was granted an 0-licence in the Western Traffic Area He also applied for the licence in the North-West, which Perrett was considering. In his application form he confirmed that he held a licence in the Western Area. However, he did not say he had had a licence revoked or mention a disqualification.

In February 2002, Board was granted an interim licence in the North-West with an operating centre at Heywood, said the DTC. The Traffic Area Office had no knowledge of his previous disqualification, or his other identity.

When the proposed operating centre was investigated by the then Vehicle Inspectorate, the vehicle examiner had extreme difficulty in finding Board and his apparent transport manager. The owners of the site were unaware of any arrangement for its use.

Meanwhile, the Western Traffic Area was alerted to the fact that the CPC produced by Board might not be all that it seemed. He was asked to go into the office so that they could obtain a better copy. When he arrived, it was seen that Board was in fact Williams. He was called to a Public Inquiry in March 2002 when TC Brown revoked the licence immediately and disqualified Board from holding a licence indefinitely.

Perrett said in view of the disqualification orders, she had no power to grant the current application. In applying for a licence when disqualified, Board had committed a criminal offence and the interim licence granted last year was therefore void.
