• A company which forgot to renew its Operator's Licence and which was mbsequently prosecuted for Inauthorised use, has been ;ranted a new licence, followng a Leeds public inquiry.

Wakefield-based W R Mes3enger & Son (Haulage) had Higinally applied for a new in:ernational licence for six vehiHes and four trailers. Objections from Wakefield District Council and local residents were met by the construction of a new access road to the depot and a reduction in the vehicles applied for.

There had been complaints of vehicles parked on the road.

Amending the application to one for five vehicles and three trailers, Stephen Kirkbright, for the company, said that its previous licence had lapsed at the end of July.

Director William Messenger said the company had not applied for the continuation of the previous licence as it had not been aware that it was due to expire. No reminder was received from the Traffic Area. A vehicle was subsequently stopped, and the company immediately contacted the Traffic Area and applied for an interim licence. Messenger agreed the company had been convicted of unauthorised use.

Granting the licence with a warning, North Eastern Deputy Licensing Authority Brian Horner said that Messenger had made fundamental errors. However, he was satisfied that there had been no deliberate intention to flout the law.
