Which of the following most accurately describes the problem?

• Green ham Plant Hire Ltd trading as Scottish Plant Hire with depots at Edinburgh, Glasgow Ladybank, Aberdeen and Evanton, Ross-shire, had one vehicle removed from its licence for five weeks at Edinburgh last week when the company appeared under Section 69. The firm also applied for continuation and modification of its 0 licence for eight vehicles and six trailers, including three vehicles and four trailers to be acquired.

The firm now runs five vehicles and three trailers and admitted receipt of two GV9 prohibitions following a fleet survey on February 1 by Mr G. Sydeserff, a vehicle examiner. He reported that the records were in order and that premises and staff were adequate for the work, but the firm was unable to produce inspection records for the one specified vehicle which was also issued with an immediate GV9; all other records were available and in good order.

For the firm it was claimed that the offending vehicle was to be sold and was in its depot awaiting sale. It was possible that the inspection file covering that vehicle may have been taken out to be sent to the new owner.

Mr A. B. Birnie, the LA, said that the one vehicle had been inspected the week before the examiner placed the GV9 on it and had been used hide in that week; no defects had been found at the firm's examination. "It strains my credulity to assume these defects all happened in two days' use," he said. He accepted that the firm was looking after its smaller vehicles well but said he had to take action on the prohibitions, and decided to curtail by one vehicle the licence for five weeks.
